Employers with 5 or more employees are required to provide reasonable accommodations to their applicants and employees with disabilities. The accommodations could be for temporary or permanent disabilities that make an employee unable to perform the essential functions of their job.

Such disabilities include workplace injuries, pregnancy, and most everything else that physically prohibits an employee from doing a key part of their job. In addition, employers are required to engage in a timely, good faith, interactive process (discussion) with their employees regarding potential accommodations.

In addition, employers with 50 or more employees and public employers are also required under the Family Medical Leave Act (“FMLA”) and California Family Rights Act (“CFRA”) to give leave to their employees who have worked for them at least one year and meet certain other requirements.

These laws entitle eligible employees to take up to a 12 week unpaid leave of absence to care for a serious health condition or the serious health condition of immediate family members. Both FMLA and CFRA laws also require unpaid leave for the birth or adoption of a child. These laws also provide guarantees of reemployment to eligible employees who take such protected leaves of absence.

Employers of all sizes cannot harass employees because of their disabilities.
